Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Lumen mobile and web applications and related services (the "Service"), operated by [Tiago Almeida] ("Lumen", "we", "us"). By creating an account, joining an event or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) to use Lumen. By using the Service you confirm that you meet this requirement and that the information you provide is accurate.

2. Accounts

You sign in using a third-party provider (Google or Apple). You are responsible for activity under your account and for keeping your sign-in method secure. You may delete your account at any time from within the app.

3. The Service

Lumen lets a host create an event and collect photos, videos and voice notes from invited guests in a shared album, with optional features such as photo challenges, live prompts and downloads. Features and limits depend on the plan selected for an event.

4. Plans, purchases & billing

• Events are offered under plans that set limits such as the number of photos per guest and the maximum number of guests.
• Paid plans and add-ons are sold as one-time purchases through the Apple App Store, Google Play and/or our payments provider, and are charged to your chosen payment method at confirmation.
• Prices are shown before purchase and may change for future purchases. Applicable taxes may apply.
• Refunds are handled according to the policies of the store or payment provider used, and applicable consumer law. As a consumer in the EU you may have statutory withdrawal rights, subject to legal exceptions for digital content you have begun to use.
• Album lifetime. Unless otherwise stated, an event album remains available for a limited time (by default around 12 months) and may then be deleted. Where offered, you may extend the album or download its contents before expiry.

5. Your content

• You retain ownership of the photos, videos, voice notes and other content you upload ("Your Content").
• You grant Lumen a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce and display Your Content solely to operate the Service — including sharing it with the participants of the event you upload it to and generating thumbnails or other technical copies. This licence ends when the content or your account is deleted, except for copies retained by other event members who downloaded it, or as required by law.
• You represent that you have the rights to upload Your Content and that it does not infringe anyone's rights or break any law.
• Voice notes are automatically transcribed to text so they can be read as well as heard. Transcription is automated and is often imperfect — treat a transcript as a convenience, not a record of what was said.
• Who sees an item — an event's reveal settings are set by its host, and you can additionally mark any item you post as "hosts only", which hides it from the other guests. Hosts and admins can always see, moderate and export everything posted to their event, including hosts-only items.

6. Acceptable use

You agree not to use the Service to:

• upload content that is unlawful, infringing, harassing, hateful or that depicts others without the consent required by law;
• upload content that is sexually explicit, violent, or harmful to minors;
• violate the privacy or intellectual property rights of others;
• distribute malware, spam, or attempt to disrupt, reverse engineer or gain unauthorised access to the Service;
• use the Service for any illegal purpose.

7. Hosting an event

If you create an event, you are responsible for how you invite guests and use the content they share, and for complying with applicable privacy and image-rights laws toward your guests. You control event settings, including moderation, reveal timing and downloads.

7a. Deleting your account

You can delete your Lumen account at any time from Profile → Delete account in the app. Deleting your account removes your profile, your notification tokens and your membership of every event. Content you have already shared into an event stays in that event's album for the other participants — if you want it removed as well, delete the individual items before deleting your account, or email support@tcreations.app and we will remove it for you.

8. Moderation & removal

Hosts and admins can remove content from their events, and guests can report content. We may remove content or suspend accounts that violate these Terms or the law, at our discretion.

9. Intellectual property

The Service, including its software, design and branding, is owned by Lumen and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not copy, modify or create derivative works of the Service except as permitted by law.

10. Third-party services

The Service relies on third parties (including Google, Apple and payment providers). Your use of those services may be subject to their own terms, and we are not responsible for them.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free or secure, or that content will always be available or retained.

12. Limitation of liability

To the maximum extent permitted by law, Lumen will not be liable for any indirect, incidental, special or consequential damages, or for loss of data or content. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.

13. Indemnity

You agree to indemnify and hold Lumen harmless from claims arising out of Your Content or your misuse of the Service or violation of these Terms, to the extent permitted by law.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or where required by law. Some provisions survive termination, including content licences for copies already shared, intellectual property, disclaimers and limitations of liability.

15. Governing law

These Terms are governed by the laws of Portugal, without prejudice to any mandatory consumer-protection rights you have in your country of residence. Disputes are subject to the competent courts of Portugal, unless applicable law provides otherwise.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance.
